THE ARBITRATION INSTITUTE OF THE STOCKHOLM CHAMBER OF COMMERCE

On the 4th of December, 2007 the Partner of the law firm “International Law Offices” Nikolay Melnikov participated in the presentation of the Arbitration Institute of SCC in Ukraine. The presentation took place in the hotel of Radisson Sas in Kiev. The presentation was held by the Swedish firm VINGE. According to the opinion of the Partner Melnikov despite its young age (100 years this year) this institute may compete with English and French arbitrations and has a number of advantages, allowing the members of the process to save time and means due to the absence of the strict regulation the last ones have. Among those, who applied for arrangement of just process in this institute, are: The Canadian Concern Bombardier versus OJSC “Russian Railway”, the Cyprus company TMR Energy Ltd versus “TNK-Ukraine”, “LUKOIL Oversusas” and “Turgay Petroleum” with action to PetroKazakhstan. It is important to notice that there are also certain advantages in the system of ad hoc.

	07 december 2011 The President of Ukraine, Viktor Yanukovich, vetoed the Law ‘On Sea Ports of Ukraine’ adopted by the Verkhovna Rada and sent the bill back to the parliament with his propositions. The President notes that the legal collision will appear in case of signing the law as the provisions of the document on the port water basin will contradict the provisions of the Water Code of Ukraine. In particular, the draft provides that the water basin of a sea port is defined as a part of the water object outside the navigation pass to be granted to the port under the Resolution of the Cabinet of Ministers. But a separate decision on allotment of the water fund land is not taken. more details…
